Why time served not showing on release date
My boyfriend was sentenced to 1yr, and at his sentencing I heard the judge say 1yr with credit for time served. When he requested his release date it didn't reflect the time served instead it showed his release date as a year from his sentencing How does he get that corrected or how does he get the credit for the time he served.
When a judge says “credit for time served,” that time should be applied to the sentence, but it does not always show up immediately in the system.
In most cases, the sentence calculation is handled by the Federal Bureau of Prisons (or the state equivalent), and there can be a delay while records are updated.
Why it may not show yet:
- Paperwork from the court has not been fully processed
- Jail credit has not been verified or entered yet
- The sentence computation is still being finalized
What he should do:
- Speak with his counselor or case manager right away
- Ask for a review of his sentence computation
- Confirm that all pre-sentence custody time is included
If something is missing, staff can:
- Submit a request for recalculation
- Coordinate with records or designation staff to correct it
Once everything is properly entered, he should receive an updated release date (out date) that reflects the time he already served.
This is a common issue early on, and it is usually resolved once the proper review is requested.
